1. Introduction

Menthorama is an online learning platform specialized in the creative industry, offering courses and full career programs designed for artists, creators, and professionals. Our content is produced with high audiovisual quality and features industry-recognized experts. Through Menthorama’s platform (THE PLATFORM WEB), we provide knowledge-sharing services in fields such as acting, production, 3D design, cultural management, and many other artistic careers.

These Terms and Conditions outline the terms for accessing and using THE PLATFORM WEB. All services are considered provided in Mexico and in India, regardless of the location from which they are accessed.

2. Consent and Special Consent for Minors

By using THE PLATFORM WEB, the user (hereinafter referred to as THE USER) agrees to these Terms and Conditions. If THE USER does not agree, they must stop using THE PLATFORM WEB immediately or send an objection request to the contact email provided below.

For underage users (under 18 years old in their country of residence), a legal guardian must create and manage the account. If a minor registers without a guardian’s consent, Menthorama reserves the right to delete the account and all associated data.

THE USER who is a legal guardian (hereinafter THE REGISTERED ADULT) is solely responsible for monitoring and maintaining the minor’s account.

THE USER agrees to use the email provided at registration as their official contact for any necessary notifications.

5. Purpose of the Platform and User Consent

Menthorama provides a knowledge-sharing platform where THE USER can:

• Learn by enrolling in courses or full career programs.

• Teach by offering workshops, courses, or masterclasses (for instructors).

THE USER agrees that courses and programs are subject to the pricing, terms, and conditions set forth by Menthorama.

6. User Interaction with THE PLATFORM WEB

Any person who enrolls in a course, career program, or workshop will be referred to as THE STUDENT USER.

• THE STUDENT USER may purchase courses, workshops or subscriptions through THE PLATFORM WEB and MOBILE

• Once payment is made, THE STUDENT USER will access to our content

• It is THE STUDENT USER's sole responsibility to access the content.

THE STUDENT USER may:

• Access course materials and interact with the platform.

• Request a refund in the case of a live masterclass only if the instructor did not deliver the course. For pre-recorded career programs and workshops, refunds do not apply. Refunds do not apply either if the student dislikes the content.

• Report technical issues to team@menthorama.com

• Ensure they have the necessary technology to access THE PLATFORM WEB.

• THE STUDENT USER is responsible for maintaining their login credentials and holds Menthorama harmless for any misuse.

7. Payments & Refunds

Refunds will be processed within 10 business days if the instructor cancels or interrupts a course. If cancellation occurs before or during the course, Menthorama will refund 90% of the payment (the remaining 10% covers administrative fees). Refunds will not apply if the instructor reschedules the course.

8. Taxes

Course and workshop prices do not include VAT (IVA) or GST. If THE USER requires an invoice, they must pay the applicable tax amount.

9. Service Suspension & Platform Availability

Access to THE PLATFORM WEB and the use of its information and content are the sole responsibility of THE USER.

Menthorama shall not be liable under any circumstances, either directly or indirectly, for any damages, lost profits, or consequential losses arising from the use of the information and content on THE PLATFORM WEB or any materials accessible through it.

THE PLATFORM WEB may contain links to third-party pages, both within and outside the platform. In all cases, Menthorama does not control or supervise the content of these external pages, and therefore disclaims all liability regarding their existence, availability, or the information they contain.

Furthermore, Menthorama shall not be responsible, either directly or indirectly, for products or services offered by third parties, nor for any content, opinions, or statements made by external entities that may be accessible through THE PLATFORM WEB.

System Interruptions and/or Suspension

Menthorama aims to keep its services continuously available on the Internet. However, THE USER acknowledges and accepts that uninterrupted service cannot be guaranteed due to the nature of online platforms.

The following are examples of situations that may cause temporary service interruptions:

• Maintenance tasks on servers and data lines.

• Technical failures in servers or data lines.

• Deliberate cyberattacks targeting the security and integrity of the platform.

• Viruses or malicious code affecting pages that make up THE PLATFORM WEB.

Menthorama shall not be liable for any temporary service interruptions or the consequences that may arise from them.

Definitive Suspension of the Platform

Menthorama reserves the right to suspend or permanently terminate THE PLATFORM WEB at any time, without prior notice, and without any obligation to compensate THE USER.

THE USER acknowledges and accepts that Menthorama may, at its sole discretion, discontinue services at any time. If this occurs, Menthorama shall not be held liable for any consequences resulting from the permanent suspension of its services.

10. Intellectual Property – Menthorama

All trademarks, software, THE PLATFORM WEB, services, and original content provided by Menthorama on THE PLATFORM WEB are protected under applicable copyright and industrial property laws. All intellectual property belongs to Menthorama, and its reproduction, distribution, or use without explicit authorization is strictly prohibited.

Menthorama is committed to protecting intellectual property and strictly prohibits the unauthorized distribution, copying, or publication of content protected by intellectual property laws.

By accepting these Terms and Conditions, THE USER receives a temporary, non-exclusive license to use THE PLATFORM WEB solely for the purposes described herein.

If Menthorama is notified of any intellectual property or industrial property infringement by THE USER, or if THE USER lacks the necessary permissions, Menthorama reserves the right to suspend or terminate the dissemination of the infringing content on THE PLATFORM WEB, and may also suspend or terminate THE USER’s account in accordance with these terms.

Regarding third-party intellectual property, Menthorama ensures that it has the necessary permissions, agreements, and licenses to use such content legally.

11. Limitation of Liability

Menthorama, its providers, or affiliates are not responsible for:

1. Indirect, incidental, or consequential damages.
2. Costs of acquiring substitute products/services.
3. Data loss or service interruptions.
4. Any amount exceeding fees paid in the last 12 days before the event in question.

This limitation of liability is subject to applicable laws.

12. Notifications

Menthorama will communicate any updates via THE PLATFORM WEB or email. Users should send any inquiries or requests to team@menthorama.com

13. Termination of Service

Menthorama may suspend or terminate user access at any time without prior notice. THE USER may also cancel their account at any time. Personal data will be processed as per the Privacy Policy.

14. Assignment of Rights

These Terms and Conditions apply to Menthorama, THE USER, INSTRUCTORS, and STUDENT USERS. No party may transfer its rights without prior consent.

15. Modifications

Menthorama may modify these Terms and Conditions at any time. Updates will be published on THE PLATFORM WEB with an effective date.

16. Governing Law & Jurisdiction

These Terms and Conditions are governed by Mexican and Indian laws. Any disputes will be settled in the courts of Mexico City and Bangalore city, with both parties waiving any other jurisdiction.
